The WTO has been identified as a problem in the alleviation of poverty in developing countries, because it has its basis in Western Private International law and economic theory. This dissertation is going to discuss the theory of free trade and globalization and whether it is the best approach to alleviate poverty in developing countries. Then it is going to discuss whether this argument is founded, by considering Private International Law Cases and where these cases have their history. Finally, it is going to determine whether there is a better approach than the WTO's free trade approach. The first question to ask though is what is the WTO and what are it abiding principles. The WTO deals with the rules of trade between countries, it is through the WTO that disputes between countries are settled. The abiding rules are the Uruguay Round and the more commonly known GATT negotiations, which is the predecessor of the WTO and born at the end of the Second World War. The problem with GATT and the later WTO organization is that it has it roots in the Western countries and has failed to properly understand the needs of the developing world. It has brought forth its free trade rules, which instead of alleviating poverty in developing countries, has created an unstable development.
