The paper looks at the present law governing the making of a will and shows how it is governed largely by the Wills Act, 1837. Generally, for a will to be valid, the testator must be of full age and capacity, and the paper demonstrates with reference to case studies how the disbursements of assets and property from valid wills works in practice, and what happens to the estates of those who have not made a will – or who have been insufficiently precise in their wording in relation to beneficiaries.
