The paper looks at the Data Protection Act (DPA) 1998 arguing that its substantive provisions as well as their interpretation do not adequately protect the data of UK citizens. The rationale behind the introduction of the Act is examined reviewing case law under the Act and concluding that DPA provisions are inadequate in protecting the data of UK citizens.
