This proposal presents research for a dissertation on decision making in criminal trials, and aims to compare the English Jury system and the French Civil Law system. The proposal presents the two research questions as should impartiality be decided as more important than the wellbeing of vulnerable witnesses in England, and should the direction and supervision of the jury, evidence and court be identified as the essential elements of the proceedings and arguably trumping objectivity in France.
