This paper comprises three questions relating to the determination of a lease. The first question is a problem question (scenario) that looks at whether the owners of three freehold estates can obtain vacant possession of respective leases in order to the sell the properties. This question deals with the creation of a valid lease, periodic tenancies and the difference between a lease and a licence. The second question is a report of cases in the last ten years concerning the surrender of a lease by operation of law. The last question describes the research strategy for the first two questions
