The paper looks at the reforms introduced by the Land Registration Act 2002 relating to overriding interests in land arguing that the Act rather than make the operation of the concept of overriding interests less problematic makes it even more so by increasing the occasions on which overriding interests can be created, making the determination of interests that may qualify as overriding on registered land more complicated, leading to uncertainty for conveyancing transactions and ultimately generating litigation.
