The paper examines the use of arbitration in international commercial law for the resolution of international business disputes. Evolution of arbitration as a tool of dispute resolution is reviewed, definitions of international arbitration and international commercial law are presented, the issues of cross-border transactions and cross-border litigation are addressed arguing whether arbitration allows more freedom to the parties making the conduct of proceedings less formal and applying transnational law and custom.
