The paper examines a modern approach to the gravity of the loss suffered by innocent parties due to the breach of the contract. The modern approach is compared to the old approach where the court was less concerned about the severity of the breach. The terms ‘warranty’ and ‘condition’ are defined with regard to the Sale of Goods Act (SGA) 1979. References are made to related case law and statutory frameworks.
